Please read these Terms of Service carefully before using OliveCast. By accessing or using the Service, you agree to be legally bound by these Terms. If you are using OliveCast on behalf of an organisation, you represent that you have the authority to bind that organisation.

1. Acceptance of Terms

By accessing or using OliveCast ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

OliveCast provides a cloud-based platform for managing, storing, and reviewing recordings from body cameras and other devices. Features include recording upload, playback, organisation, team management, and access controls. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activities that occur under your account. Notify us immediately at support@olivecast.com if you suspect unauthorised access to your account.

4. Acceptable Use

You agree not to use the Service to: (a) upload or distribute recordings that are illegal, harmful, or infringe on any third-party rights; (b) attempt to gain unauthorised access to other accounts, systems, or networks; (c) use automated tools to scrape, crawl, or extract data from the Service; (d) transmit malware, viruses, or other malicious code; (e) violate any applicable law or regulation. We reserve the right to suspend or terminate accounts that violate these restrictions.

5. Intellectual Property

OliveCast and its licensors retain all intellectual property rights in the Service, including software, design, and trademarks. You retain ownership of all recordings and content you upload ("Your Content"). By uploading content, you grant OliveCast a limited, non-exclusive licence to store, process, and display Your Content solely to provide the Service to you.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that any personal data you upload about third parties (such as individuals captured in recordings) complies with applicable privacy laws, including obtaining any necessary consents.

7. Subscription and Billing

Access to certain features of OliveCast may require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with at least 30 days' notice. Failure to pay may result in suspension or termination of your account.

8. Termination

Either party may terminate these Terms at any time. You may terminate by deleting your account. We may terminate or suspend your access immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, OliveCast, or third parties, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OLIVECAST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OLIVECAST AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where appropriate, notify you by email or via an in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
